I just saw this..

Is this okay with the estate? do they need/have the okay to use his name and image (or perhaps they already got permission)...

I asked the guy if this was officially licensed and his reply was very lame. I think JPI should should send him a cease and desist order for blatantly trading on Jaco's name, even if he doesn't use the last name...I don't think he has a legal leg to stand on.

For your information, the Jaco Pastorius estate is pretty cantankerous about Jaco Pastorius-related products in the past (CDs and books, for example). If I were to mention Jaco Pastorius in a product anywhere, I might experience some legal trouble from them.

"Jaco" is just a Portuguese first name (a variant of "Jacob"). I have made no reference to the surname "Pastorius" in my fretless bass sample library, leaving the correct surname up to the user's imagination.

Though they are not using Jaco samplings, but creating bytes that sound like him, they are still using his famous nickname everyone knew him by. I don't think that "Jaco" is a Portuguese first name, I believe we would have heard that before now.

FYI: I've forwarded the info to the lawyers for the estate and Mary and they both thanked me and said they would look into it.

The guy's website has a lot of text about Jaco and his playing and how his bass now is ruined so they created a replica of it to make these samples. Someone on the other Jaco site piped in from Portugal saying that "Jaco" is not a name used over there...

I would hope too that fans of Jaco will boycott his product until this is straightened out, and ask the estate to release a true, Jaco sound and groove library, if they are so inclined. I'd love to hear Jaco's riffs and sounds in modern music and have the estate benefit from it. With products out like Abelton Live, Pro Tools, and Reason, it would be great to have a real Jaco library out there to work with.
